Terms and Conditions of Service.

These Terms and Conditions apply to and govern the relationship between Kili Transfers (“the company”, “we”, “us”, “our”) and anyone (the client, the user, the passenger, you) who uses www.kilitransfers.com with regard to the matters set out herein.

Definitions.

“Company”, “we”, “us”, “our” means Kilitransfers, a business name trading under current Tanzanian legislation and registered with the Business Registration and Licensing Agency of Tanzania, under license number 448089.
“Customer” means the person who pays for the Booking.
“Passengers” means all passengers named and unnamed on the Booking.
“Lead passenger” means the first passenger named on the Booking and whose name shall appear on the airport pick-up signboard.
“You” and “your” means any customer, including all passengers (or any of them as applicable) named on a Booking.
“Transfer reservation”, “Booking” means a single reservation for Transfer Services made with us by an individual via email, the booking platform or by a phone call.
“Transfer Deposit”, “Deposit” means a pre-payment of 40% of the transfer cost quoted at the time of booking and that is done online via the platform or in cash at our office.
“The Transport Operator”, “Transport Operators” means a third party professional transport service provider that will perform a transfer on our behalf when needed.
“Partners” means any individual, group of people, business, company including Transport Operators, Travel Agents, Tour companies, Hotels, Lodges, Hostels, Non-Governmental Organizations and Environmental Organizations who directly or indirectly work with Kilitransfers on any of the company’s business activities.
 “Booking Platform or Platform”means the transfer service booking facility of Kilitransfers (whether available at kilitransfers.com or any other site, or in or through any other medium) and includes, incorporates or contains any data (including any associated software or information, whether in human or machine readable format) inputted by Kilitransfers and which is used to facilitate Bookings.
“Transfer service” means any service provided by us for the carriage of passengers by road and includes any other service provided by us relating to or incidental to that carriage.
“Transfer Voucher”, “Booking Voucher”, “Voucher” means the written confirmation of the Booking we will send to you by email upon receipt of transfer deposit.
“Itinerary” means the information contained on your booking voucher that includes the lead passenger’s details, number of people, date and time, destination and pick-up points, trip distance and duration, vehicle details, hotel or residence name, address and contact details and all flight details.
“Contract” means the Booking and these Terms, and any other terms and conditions stated to apply to the Booking.
“Terms” means these terms and conditions.
“Website”, “Websites” means www.kilitransfers.com or any other website owned or operated by us.

Validity of the Agreement.

If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.
Failure by either Kilitransfers (www.kilitransfers.com) or you to exercise any right or remedy under these Terms does not constitute a waiver of that right or remedy.

Your Age and Responsibility By entering into this Contract you represent and warrant that you are at least 18 years of age or at least the age of majority in your state or province of residence and possess the legal right and ability to enter into these Terms and to use this Site in accordance with the terms and booking conditions herein. You also declare that you are in full use of your mental faculties thus enabling you to comply with all your legal responsibilities concerning this agreement.
You also warrant us your consent to allow any of your minor dependents to use this site and are aware that unaccompanied minors will not be granted transfer services by the company under any circumstances.
The services to be supplied are in accordance with the details specified in the Transfer Voucher sent by email. It is your responsibility to provide at the time of reservation full and accurate addresses for the pickup and destination points. It is therefore your responsibility to print out and check the Transfer Voucher for accuracy. If the details of the Transfer Voucher are incorrect you must contact our Customer Service Centre immediately to rectify these. Particular care should be taken when completing the reservation to ensure that all compulsory fields as indicated by an asterisk (*) have been filled in accurately. We are not liable for any reservations made which are impossible to carry out and you will not be reimbursed for such reservations.
You are solely responsible for carrying all documentation necessary for frontier crossing. We hereby refute all liability and refuse to incur any supplementary expenses caused by failure to carry these documents or by failure to observe customs, police, tax authorities or administrative rules of those countries where entry is required. The Transfer Voucher is not a valid documentation to obtain entry visas.
In the event of us having to pay a deposit or fine to the Authorities of other countries as a result of your failure to observe the laws, regulations, etc. or other travel requirements of those countries which you intend to enter, leave or pass through, you will be held solely responsible for reimbursing us, and we reserve the right to hold any of the monies already paid to us until you can provide proof of reimbursement of such fines, charges etc.
We reserve the right and you hereby authorize us to charge your credit or debit card for any damage incurred to the transfer vehicle (including without limitation specialist cleaning) or for any items that are missing when you leave.
We reserve the option not to accept future Bookings in the event of serious or repeated incidents involving any Customer.

Proprietary Rights.

Information contained on the Kilitransfers Site concerning any products and services may only be applicable in certain areas. You acknowledge and agree that all materials contained in the Site and provided to you during your use of the Site (“Content”) are the property of Kilitransfers.
You may retrieve and display content from the Site on a computer screen, phone, tablet or any other electronic device that has the ability to display information, print individual pages on paper (but not photocopy them) and store such pages in electronic form on disk (but not on any server or other storage device connected to a network) solely for your personal, non-commercial use.
You agree not to copy, modify, distribute, sell or create derivative works based on any of the Content. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

The Services of Kili Transfers.

Kilitransfers provides airport transfer services using a fleet of vehicles owned and maintained by Kilitransfers and its partners. Prices, restrictions and availability of goods and services from our partners may change without notice and reservations are subject to applicable taxes and any other fee required to be withheld by law.
Any reservations you make on this Site will be directly with Kilitransfers and will be subject to these terms and conditions. Unless otherwise agreed or specified, Kilitransfers does not charge users any fee for the provision of its booking and reservation services.

Content Disclaimer.

The content herein is intended for entertainment, information and booking purposes only. While Kilitransfers together with its partners who supply information which is available on the Site will make all reasonable efforts to verify that the information presented on www.kilitransfers.com is accurate and current, Kilitransfers makes no expressed or implied warranties about the information, the services, or any other element of the Site.
The views and opinions expressed on www.kilitransfers.com are not necessarily those of Kilitransfers. The provision of incomplete or inaccurate information by users of the Site may result in the delay or cancellation of reservations by Kilitransfers. We shall not be liable for transmission errors or for delays/cancellation of reservations or any other acts or omissions of featured third party providers.

Purchase of Products and Services.

We reserve the right to refuse service to anyone for any reason at any time. We reserve the right to modify or discontinue the Service (or any part or content thereof) without notice at any time. Prices for our products are subject to change without notice.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the site. We cannot guarantee that your device monitor’s display of any color will be accurate. We do not warrant that the vehicles displayed on our site will be exactly the same as the ones that will be sent to your service. Make, model, year of manufacture and color may vary depending on the availability of vehicles at the time of booking.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer.
All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Reservations and Payments.

Transfer reservations are made through our booking platform provided on the site or by contacting us via the email provided on the site.
Transfers are booked and confirmed only upon receipt of a 40% deposit of the total transfer fare quoted at the time of booking which is payable via our integrated online payment system.
All reservations made via email, a phone call or directly at our office will also be subject to this deposit. An invoice with the deposit amount will be created by the company and sent to you the client via email to facilitate the payment.
A transfer reservation will not be confirmed before this deposit has been paid. When the Company acknowledges receipt in writing of the transfer reservation to you, it shall be deemed to constitute acceptance and confirmation of the reservation. By paying a deposit, you the client and the company are deemed to be under contract for the date quoted for your transfer. The payment due shall be handed over in cash to the driver upon pick-up or drop-off at the airport or destination.
Minors are strictly prohibited from seeking any service from us, and their parents, legal guardians or other persons responsible for them should contact us immediately should a minor make a Booking with the Company for the provision of a service in order to enable us to cancel the registration forthwith. Minors are not allowed to travel with us without an adult passenger in their company.

Itinerary Changes.

The booking voucher includes your requested destination / pick-up point, date, time, number of people and your accommodation address. Changes to your itinerary can only be done to the following categories:

  • Date
  • Time
  • Accommodation address
  • Lead Passenger name
  • Lead Passenger Phone number and email
  • Any additional information

Destination, pick-up point and the number of people can’t be changed once a transfer has been reserved. To change these, a request must be sent in writing by email to info@kilitransfers.com prior to the date of travel. This will be treated as a new reservation and a new booking voucher will be issued and the previous one will be void. Your transfer deposit will be allocated to this new reservation.
Any changes are subject to availability and you are liable for any increased service cost resulting from requested change.

Cancellations and Refunds.

Any cancellation of a reservation must be done via the “Manage booking” platform or in writing to the company’s email address. All written cancellations shall only be effective upon its acknowledged receipt by the Company. In the event that cancellation fees are applied, 100% of your transfer deposit shall be forfeited. In these instances we will email you a cancellation note which may be used to claim the expense back against your tour operator, airline, or travel insurance provider. Reservation fees shall only be forfeited in the following circumstances:

  • When a cancellation happens less than 24HRS before the pick-up time
  • In the event of a “no-show” i.e. when you reserve a transfer and you don’t show up
  • When we can’t execute or complete a transfer as a direct or indirect result of force majeure or any circumstances beyond our reasonable control
  • When we can’t execute a transfer due to incomplete information provided by you at the time of booking

Refunds to you will be made in full whenever you make cancellations more than 24HRS before the scheduled pickup time of the transfer service you wish to cancel. In rare occasions where we may be forced to cancel your transfer reservation, we shall refund you in full but we shall have no further liability to you arising out of such cancellation.

Waiting time.

The maximum waiting time for any ‘from the airport’ transfer is 2 hours from the stated flight arrival time. After this time has elapsed, the driver will leave the airport and your reservation will be treated as a ‘no-show’. In the event that clearing customs and obtaining your visa is taking too long, contact our customer service center as soon as possible to request extra waiting time that is offered free of charge.
For all ‘to the airport’ transfers, the maximum waiting time is 20 minutes. Should you need extra waiting time, contact our customer service center so that the driver may be informed of this. Failure to do so will result in the driver leaving and your reservation will be treated as a ‘no-show’.
In both ‘from the airport’ and ‘to the airport’ transfers, the driver will arrive 20 minutes before the stated transfer commencement time. Should your plane arrive more than 20 minutes before the original arrival time and the driver hasn’t arrived yet, please wait until the required time has elapsed before contacting us. In the unlikely event that your driver doesn’t show up, contact us immediately on the customer care number provided on your booking voucher. DON’T take an airport taxi before calling us first!

Child pricing.

All our rates are per vehicle and thus we don’t offer special rates for children and infants. All children and infants count towards the occupancy of the vehicle, regardless of age, and thus should be included in the total number of passengers at the time of booking.

Child seats.

We do recommend the use of booster or child seats for those under the age of 12, or up to 135cm, for safety purposes. During the booking process you are given the chance to reserve child or baby seats completely free of charge.
The lead passenger must check, under his/her solely responsibility, that such child restraint devices are suitable for the vehicle and are properly used and installed in it. The company assumes no liability resulting from any failure to use, install, or check the restraint device, or resulting from its incorrect use.
If you wish to bring your own child or booster seat, we must be advised of this information before you travel. This is to ensure that the vehicle provided can accommodate the seat. Large groups are usually transferred by minibus or coach and in these vehicles it is not possible to use a child seat as the vehicles do not have compatible seating.
We will endeavor to ensure that child seats are provided where they have been booked. There may be instances when such seats are unavailable. In such cases, you will be informed beforehand so that you may bring your own child seat. If no child seat is available, children of three years of age and over may travel as long as they wear an adult seat belt. Children under three years of age may be transported without a safety restraint as long as they travel in the rear of the vehicle and under adult supervision.

Wheelchairs and bookings for disabled passengers.

Transfer services for disabled passengers must be requested by contacting us via email. We will try our best to meet your requirements, although we are not specialists in transfers for disabled passengers. Disabled passengers using our services must be able to board the vehicle independently or with the assistance of those in their party. We only take foldable wheelchairs. We currently don’t operate any wheelchair friendly vehicle.

Multiple Drop-offs.

During the booking process you are given the opportunity to pre-book multiple drop-offs if your group will be split between more than one accommodation address. The multiple drop-off address must be located in the same destination as your principal accommodation address.
A maximum of 10 drop-offs can be pre-booked and each drop-off is charged an additional US$5. This will be automatically included in your final transfer quote upon check out in the booking process. Multiple drop-off duration is limited to 10 minutes per drop-off.

Luggage Allowance.

Our 3 and 5 seater transfer vehicles have limited luggage capacity and thus a luggage limitation of one medium suitcase and one handheld bag is imposed when you book one of these vehicles for your transfer. Our 10 and 20 seaters, however, have metal roof racks that allow for an almost unlimited luggage capacity. Luggage stored on these roof racks is covered with a waterproof tarpaulin incase it rains during the transfer.
All abnormally shaped and outsized luggage must be declared at the time of booking on the “comments or remarks” section of the booking platform with all the relevant details like dimensions and quantity. We may request that you send us pictures of the luggage via email and if we believe they’ll require a bigger vehicle to transfer, the extra cost of the vehicle will be added to your original transfer quote. The passenger shall be liable for all expenses incurred should additional vehicles be required to transport non-declared excess and/or abnormal or oversized luggage.
Your acceptance of the proposed contract and its terms and conditions is considered as tacit agreement that under no circumstances will you include in your luggage, nor carry on your person, any object in contravention with the current legislation of the United Republic of Tanzania in which the transfers will be offered (drugs, firearms, explosives etc.), nor those likely to be injurious to any third party, nor any items of excessive size, weight, fragility or perishability. Unless you are travelling with a guide dog / assistance dog, animals are not allowed.
All pieces of luggage must be securely labeled with the owner’s name and destination address. We cannot be held responsible for locating lost luggage that was not correctly labeled. Transport of luggage and other belongings is undertaken solely at your risk and under no circumstances can we be held responsible for any loss or damage. Such risk of loss or damage should be the object of private insurance taken out by you prior to departure.
Insurance
The Company strongly recommends that you obtain the following types of insurance which are commercially available:
– Accident, Death and Disability
– Major Medical
– Emergency Medical Evacuation
– Loss of Personal Effects
– Trip Cancellation
By accepting these terms and conditions, you acknowledge that the Company does not typically provide these types of insurance to you or arrange them for your benefit, that the Company has no obligation to provide these types of insurance for you, that the costs of these insurances are not included in your transfer costs payable to the Company unless expressly so stated on your invoice, and that it is your responsibility to provide for these coverages if you want to have them.
Please read all the contract details and print the documentation so that you can take it with you when you travel. Comprehensive travel insurance will cover you for many eventualities that are beyond our control.
Lost Items
If you believe you have lost an item(s) in one of our vehicles during a transfer, please let us know immediately so that we may start a follow up and return your lost property to you promptly. It is our drivers’ duty to check their vehicles thoroughly after each transfer to ensure that any items left behind in their vehicles by passengers are handed over at our Lost Items department.

Any lost item(s) that is handed over to us will be recorded in a log book and kept in a safe place at our office for one month. After this period, any unclaimed items will be donated to a relevant charity or orphanage. We do not take possession of any lost item(s) handed over to us.

In the case that your lost property is with us, we will arrange a date and time for you to pick it up at our premises. If you wish, we can ship your lost items to your address, though you will be liable for all shipping and handling fees based on your location. Any taxes (domestic or international) that may arise during shipment will be carried by you. Kili Transfers will not incur any costs whatsoever that will arise from shipping your lost property.
Force Majeure
“Force Majeure” means, in relation to the Company, any circumstances beyond the reasonable control of the Company including, but without limitation, acts of God, explosion, flood, tempest, fire or accident, war or threat of war, terrorist attacks, sabotage, insurrection, civil disturbance or requisition, sickness, quarantine, government intervention or hindrance of any kind, weather conditions or other untoward occurrences, accidents suffered by third parties on the transfer route, police checkpoints, unusual traffic levels, or industrial action.
The Company shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, because of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure.
If the Company is affected by Force Majeure it shall be entitled to, and may in its sole and absolute discretion, vary or cancel any itinerary, or arrangement in relation to the transfer.
The company will not pay any compensation or refund where the performance of our obligations is prevented or affected directly or indirectly by or as a result of force majeure or any circumstances beyond our reasonable control. 
User Conduct
The booking system on the Site is provided solely to permit users of the Site to determine the availability of products and services and to make legitimate reservations or otherwise transact business with us and for no other purposes. The name, address and other information (including payment data if applicable) that you provide via this Site, together with information regarding the manner in which you use this Site will be used by Kilitransfers in accordance with the Privacy Policy set forth in this site.
You agree not to use the Site to:

  • Upload, post or e-mail any content onto the Site;
  • Transmit any material that contains software viruses or any other computer codes, files or programs; or
  • Interfere with or disrupt the Site or servers or networks connected to the Site.

In entering into this contract you tacitly accord to us and our partners the right to refuse to transport any passenger who, at the driver’s discretion, may be under the influence of alcohol or drugs and those whose behavior may be considered dangerous to the driver of the vehicle, to other passengers or to themselves.

  • No alcoholic drinks may be carried in the Transfer vehicles for the purpose of on-board consumption. This prohibition extends to narcotics.
  • Smoking is forbidden inside vehicles or the immediate vicinity.
  • Eating inside the vehicle is not allowed.

Indemnity
As a condition of use of this Site, you agree to indemnify Kilitransfers, its officers, agents, suppliers and other partners from and against any and all liabilities, expenses (including reasonable legal fees) and damages arising out of claims resulting from any material you post to or transmit through the Site including claims for Intellectual Property right infringement or defamation.

Complaints.

If the service you received from us does not meet your expectations, this must be immediately reported to our Customer Service Centre and, if possible, at the moment the problem occurs. Complaints received after the transfer service has been completed and which were not brought to our attention at the time of the transfer may not be upheld as we were not given an opportunity to intervene or otherwise provide assistance. Our contact details are provided on your Transfer Voucher.
Written complaints should be received no later than 21 days after your transfer date and sent by email to info@kilitransfers.com
In the event that you wish to report an issue about our online booking process or our Customer Service Centre, please address your complaint to manager@kilitransfers.com
Limitation of Liability
Kilitransfers does not guarantee the accuracy, availability, timeliness, completeness, performance or fitness for a particular purpose of the site or any part of the site. Additionally, Kilitransfers makes no warranty that the site is free from infection by viruses. However every endeavor will be made by us to rectify in the shortest possible period any errors to which our attention has been drawn.
All implied warranties are excluded from these terms to the extent that they may be excluded as a matter of law.
To the extent permitted by law, Kilitransfers will not be liable for any direct, indirect, consequential or exemplary damages (including without limitation, damages for loss of data, goodwill or profits) arising in contract, tort or otherwise from your use of or inability to use the site, any content of the site or any services offered by the site. These limitations are fundamental terms of this agreement and the site would not be provided to you without such limitations.
Kilitransfers’ liability will not be limited in the case of death or personal injury directly caused by Kili transfers negligence or for any other liability which cannot be excluded by law.
This means that, subject to these Terms, we may accept responsibility if, for example, you suffer death or personal injury or your Transfer Service is not provided as promised or proves deficient as a result of the failure of ourselves, our employees, or transfer operators to use reasonable skill and care in making, performing or providing, as applicable, your contracted transport service. Please note, it is your responsibility to show that reasonable skill and care has not been used if you wish to make a claim against us.
The site may contain links to other internet sites, either directly or through frames and, where possible, we will make clear where such links are being made. Those sites are provided by independent third parties and Kilitransfers is not responsible for their availability or content.
We are absolved of all liability whatsoever where the customer makes a contract for another service directly with a third party transport operator before, during or after the transfer.

Offers and Promotions.

Kilitransfers may make information available on the Site regarding specific services, offers or promotions which Kilitransfers and certain transfer service providers are conducting (“Offers”). Any such Offer is subject to the specific terms, conditions and restrictions listed on the Site in connection with such Offer.
Each Offer is void where prohibited by law. Please refer to and read carefully the terms of use, booking conditions and restrictions included on the Site in connection with each particular Offer.

Advertising and Sponsorship.

Part of the Site may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Site complies with relevant law.
Kilitransfers does not endorse the products and / or services advertised and are not liable or responsible for any error or inaccuracy in advertising or sponsorship material.

Laws and Jurisdiction.

These Terms of Service and any separate agreements whereby we provide you with Services shall be governed by and construed in accordance with the current laws of The United Republic of Tanzania.
We both agree that the Courts of Tanzania shall have the exclusive jurisdiction to determine any disputes, which may arise out of, under, or in connection with this agreement.

Changes to these Terms.

Due to its policy of updating and improving the site, Kilitransfers may wish to change these Terms (including those relating to your use of the Content). When terms are changed, Kilitransfers will notify you by indicating on the home page of the Site when they were last modified.
It is, therefore, important that each time you visit the site, you check to see whether there is a notification of a change to the Terms.
If you use the Site after Kilitransfers has published and notified you of the changes, you agree to be bound by those changes. If you do not agree to be bound by those changes, you should not use the Site.

Privacy Policy.

The information that you provide about yourself to Kilitransfers will only be used by Kilitransfers in accordance with the Privacy Policy set forth in this site.
